1. Compliance with Terms

Users are expected to follow the terms of service, privacy policies, and any other agreements they accept when using the service.

2. Respectful Behaviour

Users should interact respectfully with other users and the service provider, avoiding harassment, discrimination, or any form of abusive behaviour.

3. Proper Use

Users should use the service as intended and not engage in activities that could harm the service, other users, or violate laws (e.g., hacking, spreading malware).

4. Security

Users are responsible for maintaining the security of their accounts, such as using strong passwords and not sharing their login credentials.

5. Content Responsibility

Users should ensure that any content they upload, or share does not violate copyright laws, privacy rights, or other legal regulations.

6. Reporting Issues

Users are encouraged to report any issues, bugs, or violations of the terms of service they encounter.

7. Payment and Refund Policies

    • Accepted Payment Methods: Payments can be made using credit/debit cards, bank transfers, and cash.
    • Billing Cycles: Payments can be made upfront or in up to three instalments, with options for payment plans.
    • Security Measures: Payment information is protected through encryption and secure payment gateways.
    • Payment Terms: Payment is due within 7 days of receiving the invoice.
    • Late Payment: A late fee of 2% per week will be applied to any outstanding balances after the due date.
    • Refund Policies:
      1. Clients are eligible for a 50% cashback if they are not satisfied with the guidance provided in our comprehensive packages after two sessions.
      2. No cashback for cancellations within 24 hours.
      3. Refund Process: If not satisfied, send an email detailing the reasons why it didn’t work, along with your account number, contract number, bank account details, and name. The refund will be processed within 7 days.
      4. Partial Refunds: Information on whether partial refunds are available and under what circumstances.
      5. Non-Refundable Items: If a coaching session is completed and the client is not satisfied, that session will not be refunded.

8. Privacy Policy

    • Types of Data Collected: Names, email addresses, payment information.
    • Storage Locations: Data is stored in cloud storage.
    • Purpose of Data Use: Data is used for improving services, personalizing user experiences, and marketing purposes.
    • Sharing with Third Parties: Data may be shared with third parties, such as physicians, if needed and with the client’s consent.
    • User Rights:
      1. Access and Control: Users can access and control their data through the website, email, or WhatsApp.
      2. Consent and Opt-Out: Consent is always obtained via email, and users can opt-out at any time.

9. User Responsibilities

    • Adherence to Professional Standards: Calmpanion is not responsible for any medical expenses, information, advice, or interference.
    • Confidentiality: Users must maintain the confidentiality of sensitive information accessed through the service, particularly if it involves patient data or proprietary information.
    • Accurate Information: Users are expected to provide accurate and truthful information when using the service, such as during registration or when inputting data.
    • Timely Updates: Users are responsible for keeping their information up to date, such as contact details or professional credentials.
    • Compliance with Local Laws: Users must comply with all relevant local, state, and federal laws while using the service.
    • Feedback and Reporting: Users are encouraged to provide feedback on the service and report any issues or violations they encounter.

10. Dispute Resolution

    • Process: In the event of a dispute, both parties agree to first seek resolution through mediation.
    • Mediation: If mediation fails, the dispute will be resolved through arbitration in accordance with the Dubai International Arbitration Centre (DIAC) Arbitration Rules.
    • Governing Law: All terms and conditions are governed by the laws of Dubai, UAE.

11. Termination of Agreement

    • Termination by Client: Clients may terminate the agreement with 7 days’ written notice.
    • Termination by Calmpanion: Calmpanion reserves the right to terminate the agreement with 7 days’ written notice.
    • Post-Termination: Both parties are obligated to settle any outstanding payments and return any confidential materials within 7 days of termination.

12. Amendments to Policy

    • Amendments: This policy may be amended by Calmpanion at any time.
    • Notification: Clients will be notified of any changes to the policy via email at least 14 days in advance.

13. Cancellation Policy

    • Short Notice: Cancellations must be made at least 24 hours prior to the scheduled service to avoid any fees.
    • Same-Day Cancellations: No refund will be issued for cancellations made on the same day as the scheduled service.
    • No-Shows: No refunds will be issued for no-shows.
    • Cancellation Requests: Must be submitted in writing via email or through the designated cancellation form on our website.
    • Rescheduling: Clients may reschedule their appointments up to 24 hours before the scheduled service without any additional fees. Rescheduling requests made within 24 hours of the appointment will be treated as cancellations.

14. Revision Requests

    • Initial Scope: Clients are entitled to request revisions to their services without additional charges if the revisions stay within the original agreed-upon scope of work.
    • Additional Revisions: Any substantial changes or requests beyond the initial scope will be billed at an hourly rate of 500 AED.
    • Time Frame: Revision requests must be made within 5 days of receiving the final service deliverable.
    • Rounds of Revisions: Up to two rounds of revisions can be requested for any training materials or content delivered.
    • Additional Revisions: Additional revision requests beyond the second round may incur extra charges.
